WASHINGTON (AP) The Justice Department will prosecute anyone found to have violated U.S. law in the leaks of classified government documents by online whistleblower WikiLeaks, Attorney General Eric Holder said Monday.
'This is not saber-rattling,' said the attorney general, who declared that the Obama administration condemns the leaks.
Holder said the latest disclosure, involving classified State Department documents, puts at risk the security of the nation, its diplomats, intelligence assets and U.S. relationships with foreign governments.
'To the extent that we can find anybody who was involved in the breaking of American law, who put at risk the assets and the people I have described, they will be held responsible; they will be held accountable,' Holder said at a news conference on another topic. He called the WikiLeaks probe 'an active, ongoing criminal investigation. |

The secret Google order is dated Jan. 4 and directs the search giant to hand over the IP address from which Mr. Appelbaum logged into his gmail.com account and the email and IP addresses of the users with whom he communicated dating back to Nov. 1, 2009. It isn't clear whether Google fought the order or turned over documents.

Second, the unsealing order does not name either Assange or Manning, which means either that Twitter did not request permission to notify them of the Subpoena or that they did request it but the court denied it (then again, neither 'Julian Assange' nor 'Bradley Manning' are names of Twitter accounts, and the company has no way of knowing with certainty which accounts are theirs, so perhaps Twitter only sought an unsealing order for actual Twitter accounts named in the Order). Finally, WikiLeaks and Assange intend to contest this Order.

And the key question now is this: did other Internet and social network companies (Google, Facebook, etc.) receive similar Orders and then quietly comply? It's difficult to imagine why the DOJ would want information only from Twitter; if anything, given the limited information it has about users, Twitter would seem one of the least fruitful avenues to pursue. But if other companies did receive and quietly comply with these orders, it will be a long time before we know, if we ever do, given the prohibition in these orders on disclosing even its existence to anyone. |

And I think that I mean, the economic relationship between the United States and China is mutually beneficial. It's not a one-way street. And so I think both countries have an interest in keeping that stable and going forward. Jacob Appelbaum, a security researcher,Tor developer, and volunteer with Wikileaks, reported today on his Twitter feed that he was detained, searched, and questioned by the US Customs and Border Patrol agents at Seattle-Tacoma International Airport on January 10, upon re-entering the US after a vacation in Iceland.

It's very frustrating that I have to put so much consideration into talking about the kind of harassment that I am subjected to in airports.
I was detained, searched, and CPB did attempt to question me about the nature of my vacation upon landing in Seattle.
The CPB specifically wanted lap tops and cell phones and were visibly unhappy when they discovered nothing of the sort.
I did however have a few USB thumb drives with a copy of the Bill of Rights encoded into the block device. They were unable to copy it.
The forensic specialist (who was friendly) explained that EnCase and FTK, with a write-blocker inline were unable to see the Bill of Rights.
I requested access my lawyer and was again denied. They stated I was I wasn't under arrest and so I was not able to contact my lawyer.
The CBP (U.S. Customs and Border Protection) agent was waiting for me at the exit gate. Remember when it was our family and loved ones?
When I handed over my customs declaration form, the female agent was initially friendly. After pulling my record, she had a sour face.
She attempted to trick me by putting words into my mouth. She marked my card with a large box with the number 1 inside, sent me on my way.
While waiting for my baggage, I noticed the CBP agent watching me and of course after my bag arrived, I was 'randomly' selected for search.
Only US customs has random number generator worse than a mid-2007 Debian random number generator. Random? Hardly.
During the search, I made it quite clear that I had no laptop and no cell phone. Only USB drives with the Bill of Rights.
The CBP agent stated that I had posted on Twitter before my flight and that slip ended the debate about their random selection process.
The CBP agents in Seattle were nicer than ones in Newark. None of them implied I would be raped in prison for the rest of my life this time.
The CBP agent asked if the ACLU was really waiting. I confirmed the ACLU was waiting and they again denied me contact with legal help.
All in all, the detainment was around thirty minutes long. They all seemed quite distressed that I had no computer and no phone.
They were quite surprised to learn that Iceland had computers and that I didn't have to bring my own.
There were of course the same lies and threats that I received last time. They even complemented me on work done regarding China and Iran.
I think there's a major disconnect required to do that job and to also complement me on what they consider to be work against police states.
While it's true that Communist China has never treated me as badly as CBP, I know this isn't true for everyone who travels to China.
All in all, if you're going to be detained, searched, and harassed at the border in an extra-legal manner, I guess it's Seattle over Newark.
It took a great deal of thought before I posted about my experience because it honestly appears to make things worse for me in the future.
Even if it makes things worse for me, I refuse to be silent about state sponsored systematic detainment, searching, and harassment.
In case it is not abundantly clear: I have not been arrested, nor charged with any crime, nor indicted in any way. Land of the free? Hardly.
I'm only counting from the time that we opened my luggage until it was closed. The airport was basically empty when I left.
It's funny that the forensics guy uses EnCase. As it, like CBP, apparently couldn't find a copy of the Bill of Rights I dd'ed into the disk.
The forensics guy apparently enjoyed the photo with my homeboy Knuth and he was really quite kind. The forensics guy in Newark? Not so much.
The CBP agent asked me for data - was I bringing data into the country? Where was all my data from the trip? Names, numbers, receipts, etc.
The mental environment that this creates for traveling is intense. Nothing is assured, nothing is secure, and nothing provides escape.
I resisted the temptation to give them a disk filled with /dev/random because I knew that reading them the Bill of Rights was enough hassle.
I'm flying to Toronto, Canada for work on Sunday and back through Seattle again a few days later. Should be a joy to meet these guys again.
All of this impacts my ability to work and takes a serious emotional toll on me. It's absolutely unacceptable.
What happens if I take a device they can't image? They take it. What about the stuff they give back? Back doored? Who knows?
Does it void a warranty if your government inserts a backdoor into your computer or phone? It certainly voids the trust I have in all of it.
I dread US Customs more than I dreaded walking across the border from Turkey to Iraq in 2005. That's something worth noting.
I will probably never feel safe about traveling internationally with a computer or phones again.
None the less, safe or not, I won't stop working on Tor. Nor will I cease traveling. I will adapt and I will win. A hard road worth taking. |

Some in the human rights community in this country, and around the world, are questioning our commitment to freedom of expression, freedom of the press and Internet freedom in the aftermath of WikiLeaks. I am constrained in what I can say, both because individual cables remain classified, and the leak is under investigation by the Department of Justice. But let me briefly put this in context and then I will open things up for questions. WikiLeaks is about the unauthorized disclosure of classified information. It is not an exercise in Internet freedom. It is about the legitimate investigation of a crime. It is about the need to continue to protect sensitive information while enabling the free flow of public information.
We remain arguably the most transparent society in the world. The American people, through innovations including C-SPAN, are a well-informed citizenry, which is crucial to a functioning democracy. We can have a discussion about how well our democracy is functioning, and whether political figures are spending more time pandering or posturing on television than actually governing.
And, of course, in the aftermath of the tragedy last weekend in Tuscon, we pray for the recovery of Congresswoman Gabby Giffords. I am not going to speculate about what led this troubled young man to do what he did, but we should recommit ourselves to improve political discourse going forward so we can sustain a functioning democracy that is important both in the context of our national interests, but in our collective ability to solve global challenges for the benefit of our people and others.
This transparency relies upon a vibrant independent fourth estate that serves as a vital check and balance in our democracy. The First Amendment created deliberate tension in the relationship between the media and government. This tension helps to sustain effective oversight of government. When I stand up each day and answer questions about U.S. policy and actions, in a small way, I am part of this process where government is accountable to its people. And, trust me, the system works. I have the fan mail to prove it, particularly when I appear on FOX. Some FOX viewers now have me on speed dial.
Transparency does not mean there are no secrets. Whether you are a government or a business, there is proprietary information that is vital to your day-to-day function. Coca-Cola has its secret formula. Google has its search algorithm. Their success is based on these secrets. As a government, we are no different. In the conduct of our diplomacy, we have confidential interactions around the world every day. These conversations, with government officials, civil society activists, business people and journalists, help us make sense of the world and inform our policy-making. These confidential exchanges are rooted in our values and serve our national interest. They are based on mutual trust, trust that the confidence will not be betrayed.
Someone inside our government violated their sworn oath to protect the national interest and protect classified and sensitive information that is an inherent part of the conduct of our national security policy. We can debate whether there are too many secrets, but no one should doubt that there has been substantial damage in the unauthorized release of a database containing, among other things, 251,000 State Department cables, many of them classified.
We have encountered leaks before, and worked through them. We will do so in this case as well. But this case is different, in its volume and scope. Unlike the past, where someone might have smuggled out a document or file about one subject and given it to one reporter, in this case, the database contained documents that touched every part of the world, every relationship we have around the world and almost national interest. The reaction has varied country by country, but human nature being what it is, there will be impact for at least a time. Governments will be more cautious in sharing sensitive information. Why is this important? It was the sharing of information last year that enabled the United States, working with other governments, to intercept a plot to blow up cargo aircraft over Chicago. If less information is shared in the future, our policies and our actions could be less effective.
The release of this information has placed hundreds of people at risk, in many cases the very civil society activists that WikiLeaks has suggested it wants to empower around the world. We interact regularly with people in all walks of life who are trying to reform repressive societies, both inside and outside government. In some cases, their names have been withheld, but many have been exposed and are now at risk. The mere fact that classified documents now reside in unclassified and less secure databases means that this information can be intercepted by a foreign security service. So the fact that only 2,700 documents have been publicly released is small comfort to the people who have been needlessly exposed.
We are tracking hundreds of people around the world who we believe, in one way or another, are now in danger - reaching out to as many as we prudently can and helping ensure to the extent we can that they remain safe. The founder of WikiLeaks has claimed that no one has lost his or her life due to these releases. That is true as far as we know, but that is not the only measure of the impact.
Real lives and real interests have been compromised by what has been done here. We are doing everything we can to mitigate that impact, but as the Secretary of State said this week, it will take years to move beyond it.
We are a nation of laws, and the laws of our country have been violated. Since we function under the rule of law, it is appropriate and necessary that we investigate and prosecute those who have violated U.S law. Some have suggested that the ongoing investigation marks a retreat from our commitment to freedom of expression, freedom of the press and Internet freedom. Nonsense.
These are universal principles and our commitment is unwavering. These freedoms have always coexisted with the rule of law and the application of laws is in no way intended to deny access to readily available information or silence legitimate and necessary political discourse. But our belief in Internet freedom does not include the right to use the Internet to illegally inflict harm. We must exercise these rights responsibly.
WikiLeaks reminds us of the on-going challenge of how to protect vital information, whether personal or classified information, while also promoting the free flow of information that can empower people to form global communities and change the world for the better. We believe it is possible and necessary to do both. |

You make a recommendation and then I have to make a decision based upon everything else.' 4.) On 18 January 2011, over the recommendation of Capt. Hocter and the defense psychiatrist, Capt. Brian Moore, CWO4 Averhart placed me under suicide risk. The suicide risk means that I sit in my cell for 24 hours a day. I am stripped of all clothing with the exception of my underwear. My prescription eyeglasses are taken away from me. I am forced to sit in essential blindness with the exception of the times that I am reading or given limited television privileges. During those times, my glasses are returned to me. Additionally, there is a guard sitting outside my cell watching me at all times. |

(1) On 18 January 2011, over the recommendation of Capt. Hocter and the defense forensic psychiatrist, Capt. Moore, CWO4 Averhart placed me under Suicide Risk. The Suicide Risk assignment resulted in me being required to remain in my cell for 24 hours a day. I was stripped of all clothing with the exception of my underwear. My prescription eyeglasses were taken away from me and I was forced to sit in essential blindness.
(2) The basis for the above treatment was due to my alleged erratic behavior on 18 January 2011. On that date, I was pulled out of my cell for my one hour of recreation call. When the guards came to my cell I noticed a change in their usual demeanor. Instead of being calm and respectful, they seemed agitated and confrontational. Also, instead of the usual two to three guards, there were four guards. Almost immediately, the guards started harassing me. The first guard told me to 'turn left.' When I complied, the second guard yelled 'dont turn left.' When I attempted to comply with the demands of the second guard, I was told by the first, 'I said turn left.' I responded 'yes, Corporal' to the first guard. At this point, the third guard chimed in by telling me that 'in the Marines we reply with 'aye' and not 'yes.' He then asked me if I understood. I made the mistake of replying 'yes, Sergeant.' At this point the forth guard yelled, 'you mean 'aye,' Sergeant.'
(3) The harassment by the guards continued as I was escorted to my one hour of recreation. When I arrived at the recreation room, I was told to stand still so they could remove my leg restraints. As I stood still, one of the guards yelled 'I told you to stand still.' I replied 'yes Corporal, I am standing still.' Another guard then said, 'you mean 'aye' Corporal.' Next, the same guard said 'I thought we covered this, you say 'aye' and not 'yes,' do you understand?' I responded 'aye Sergeant.' Right after I replied, I was once again yelled at to 'stand still.' Due to being yelled at and the intensity of the guards, I mistakenly replied, 'yes Corporal, I am standing still.' As soon as I said this, I attempted to correct myself by saying 'aye' instead of 'yes,' but it was too late. One of the guards starting yelling at me again, 'what dont you understand' and 'are we going to have a problem?'
(4) Once the leg restraints were taken off of me, I took a step back from the guards. My heart was pounding in my chest, and I could feel myself getting dizzy. I sat down to avoid falling. When I did this, the guards took a step towards me. I instinctively backed away from them. As soon as I backed away, I could tell by their faces that they were getting ready to restrain me. I immediately put my hands up in the air, and said 'I am not doing anything, I am just trying to follow your orders.' The guards then told me to start walking. I complied with their order by saying 'eye' instead of 'yes.'
(5) I was allowed to complete my hour of recreation. During the hour, the guards did not harass me further. The guards also did not harass me when I was escorted back to my cell. Only later did I learn that there had been a protest outside the gates of Quantico the previous day. (See http://www.youtube.com/watch?v=x4eNzokgRIw).
The rally was intended to bring attention to the conditions of my confinement. It is my belief that my treatment on 18 January 2010 by the guards and later by the PCF Commander was related to this protest and my earlier complaints.
(6) After being returned to my cell, I started to read a book. About 30 minutes later, the PCF Commander, CWO4 James Averhart, came to my cell. He asked me what had happened during my recreation call. As I tried to explain to him what had occurred, CWO4 Averhart stopped me and said 'I am the commander' and that 'no one could tell him what to do.' He also said that he was, for all practical purposes, 'God.' I responded by saying 'you still have to follow Brig procedures.' I also said 'everyone has a boss that they have to answer to.' As soon as I said this, CWO4 Averhart ordered that I be placed in Suicide Risk Status.
(7) Admittedly, once I heard that I would be placed under Suicide Risk, I became upset. Out of frustration, I placed my hands to my head and clenched my hair with my fingers. I did yell 'why are you doing this to me?' I also yelled 'why am I being punished?' and 'I have done nothing wrong.' I then asked CWO4 Averhart 'what have I done to deserve this type of treatment?'
(8) CWO4 Averhart did not answer any of my questions. He instructed the guards to enter my cell and take all my clothing. At first I tried to reason with CWO4 Averhart by telling him that I had been a model detainee and by asking him to just tell me what he wanted me to do and that I would do it. However, I gave up trying to reason with him once the guards entered my cell and ordered me to strip. Instead, I lowered my head and starting taking off my clothes.
(9) CWO4 Averhart placed me on Suicide Risk, over the recommendation of Capt. Hocter and the defense forensic psychiatrist, Capt. Moore. His decision was also in violation of Secretary of Navy Instruction ('SECNAVINST') 1649.9C Paragraph 4205.5d. As a result of being placed on Suicide Risk, I was confined to my cell for 24 hours a day. I was also stripped of all clothing with the exception of my underwear. Additionally, my prescription eyeglasses were taken away from me. Due to not having my glasses, I was forced to sit in essential blindness during the day. I remained on Suicide Risk until 21 January 2010. The determination to place me on Suicide Risk was without justification and therefore constitutes unlawful pretrial punishment.
c. That the decision to strip me of all my clothing at night since 2 March 2011 was and continues to be improper.
(1) On March 2, I was informed of your decision regarding my Article 138 complaint. Understandably frustrated by this decision after enduring over seven months of unduly harsh confinement conditions, I asked the Brig Operations Officer, MSG Papakie, what I needed to do in order to be downgraded from Maximum Custody and POI Status. MSG Papakie responded by telling me that there was nothing I could do to downgrade my detainee status and that the Brig simply considered me a risk of self-harm. Out of frustration, I responded that the POI restrictions were absurd and sarcastically told him if I really wanted to harm myself, that I could conceivably do so with the elastic waistband of my underwear or with my flip-flops.
(2) Later that same day, I was approached by GYSGT Blenis. He asked me what I had done wrong. I told him that I did not know what he was talking about. He said that I would be stripped naked at night due to something that I had said to MSG [MARINES SECURITY GUARD] Papakie. Shocked, I told him that I hadn't said anything. I told GYSGT Blenis that I just pointed out the absurdity of my current confinement conditions.
(3) Without consulting any Brig mental health provider, Chief Warrant Officer Denise Barnes used my sarcastic comment as justification to increase the restrictions imposed upon me under the guise of being concerned that I was a suicide risk. I was not, however, placed under the designation of Suicide Risk. This is because Suicide Risk would have required a Brig mental health provider's recommendation in order for the added restrictions to continue. While the PCF Commander needed the Brig Psychiatrist's recommendation to keep me under Suicide Risk, no such recommendation was needed in order to increase my restrictions under POI Status. The conditions of POI Status require only psychiatric input, but ultimately remain the decision of the PCF Commander .
(4) In response to this specific incident, the Brig Psychiatrist [WHO IS THIS?] met with me. After speaking to me, he assessed me as a 'low risk and requiring only routine outpatient follow-up [with] no need for ... closer clinical observation.' In particular, he indicated that my statement about the waist band of my underwear was in no way prompted by 'a psychiatric condition.'

Mr. MARKEY. Mr. Speaker, to achieve lasting peace in Sri Lanka, there should be an independent, international investigation into alleged war crimes at the end of the country's 25-year civil war in May 2009. Last August, I joined 57 of my fellow Members of Congress in urging Secretary Clinton to press for a United Nations investigation. I renew this call now. As the Boston Globe stated in an editorial on December 29, 2010:

'No foreign leader has fared worse in the cables released by WikiLeaks than Sri Lanka's President Mahinda Rajapaksa, who has been resisting calls for an international inquiry into possible war crimes committed when Sri Lankan troops wiped out the secessionist Tamil Tigers in May 2009. In this particular case, disclosure of an American diplomat's confidential assessment serves the cause of human rights, validating the stand of Human Rights Watch, Amnesty International, and the International Crisis Group. All three have argued, rightly, for a credible investigation of alleged war crimes in Sri Lanka, whether committed by the Tamil Tigers or government forces.
The documents show that US Ambassador Patricia Butenis observed last January that no regime investigates 'its own troops or senior officials for war crimes.' She then added, in a devastating aside, that in Sri Lanka 'responsibility for many of the alleged crimes rests with the country's senior civilian and military leadership, including President Rajapaksa and his brothers.'
The ambassador's candor illuminates a recurring contradiction between the moral imperatives of human rights and the cold logic of diplomacy. Videos and survivor accounts strongly suggest that hundreds, if not thousands, of Tamils were stripped naked, had their hands bound behind their backs, and were murdered during the final weeks of the government's war against the Tigers. Yet for reasons of state, neighboring powers India and China show no interest in documenting and punishing such crimes. All the more reason for America to heed the awful truth in Butenis's cable and push for a legitimate UN investigation of war crimes in Sri Lanka.' |

On January 18, 2011, defense was notified that PFC Manning at the direction of XXXXXXXXXX, was placed in suicide risk. This decision was made over the recommendations of XXXXXXXXXX and the defense appointed XXXXXXXXXX. When PFC Manning was being ordered to surrender his clothes as part of the unnecessary suicide risk, the Brig made the decision to videotape this event along with an interrogation of PFC Manning by XXXXXXXXXX and others. On 19 January 2011, the defense filed a preservation of evidence request with the government and a request for the production of the video. The government has yet to respond to the defense request. The defense believes the video will support PFC Manning's claim of unlawful pretrial punishment. |

WASHINGTON (Reuters) - Internal U.S. government reviews have determined that a mass leak of diplomatic cables caused only limited damage to U.S. interests abroad, despite the Obama administration's public statements to the contrary.
A congressional official briefed on the reviews said the administration felt compelled to say publicly that the revelations had seriously damaged American interests in order to bolster legal efforts to shut down the WikiLeaks website and bring charges against the leakers.
'I think they just want to present the toughest front they can muster,' the official said.
But State Department officials have privately told Congress they expect overall damage to U.S. foreign policy to be containable, said the official, one of two congressional aides familiar with the briefings who spoke to Reuters on condition of anonymity.
'We were told (the impact of WikiLeaks revelations) was embarrassing but not damaging,' said the official, who attended a briefing given in late 2010 by State Department officials.
WikiLeaks caused a media and diplomatic uproar late last year when it began to dribble out its cache of more than 250,000 U.S. diplomatic cables.
Major headlines were generated by some of the cables, which revealed that Saudi leaders had urged U.S. military action against Iran and detailed contacts between U.S. diplomats and political dissidents and opposition leaders in some countries.
'From our standpoint, there has been substantial damage,' State Department spokesman P.J. Crowley told Reuters.
'We believe that hundreds of people have been put at potential risk because their names have been compromised in the release of these cables,' he said.
YEMEN TIES STRAINED
National security officials familiar with the damage assessments being conducted by defense and intelligence agencies told Reuters the reviews so far have shown 'pockets' of short-term damage, some of it potentially harmful. Long-term damage to U.S. intelligence and defense operations, however, is unlikely to be serious, they said.
Some of the cases of more serious damage have occurred in countries where WikiLeaks' revelations have publicized closer ties with Washington than local officials publicly admit.
For example, a cable released by WikiLeaks quoted Yemen's president saying he would allow U.S. personnel to engage in counter-terrorism operations on Yemeni territory even as he said publicly that the operations were being handled by domestic security forces.
U.S. officials say the continued media attention on such revelations has made it difficult for Washington to repair relations with governments critical to its counter-terrorism operations, such as Pakistan and Yemen.
Two U.S. intelligence officials said they were aware of specific cases where damage caused by WikiLeaks' revelations have been assessed as serious to grave, though they said they could not discuss the subject matter because it remained highly classified.
Crowley said the State Department had helped move a small number of people compromised by the leaks to safer locations.
Damage assessments by the State Department, Pentagon and U.S. intelligence community are still continuing, so the current view of many officials that damage has been limited could change if and when WikiLeaks and its media partners publish more documents.
The assessments also cover the leaking of tens of thousands of military field reports from Iraq and Afghanistan.
WIKILEAKS 'RECKLESS, IRRESPONSIBLE
Special investigative teams are also combing through unpublished material which U.S. investigators believe is in the hands of WikiLeaks.
U.S. officials and sources close to WikiLeaks have said the website is sitting on a cache of documents related to the U.S. detention facility at Guantanamo Bay, Cuba, which includes intelligence-based risk assessments of detainees.
A spokeswoman for the office of Director of National Intelligence James Clapper, which oversees all U.S. intelligence agencies, said, 'The irresponsible and reckless behavior of WikiLeaks has of course caused damage and will continue to be damaging in the months and years to come.'
But current and former intelligence officials note that while WikiLeaks has released a handful of inconsequential CIA analytical reports, the website has made public few if any real intelligence secrets, including reports from undercover agents or ultra-sensitive technical intelligence reports, such as spy satellite pictures or communications intercepts.
Shortly before WikiLeaks began its gradual release of State Department cables last year, department officials sent emails to contacts on Capitol Hill predicting dire consequences, said one of the two congressional aides briefed on the internal government reviews.
However, shortly after stories about the cables first began to appear in the media, State Department officials were already privately playing down the damage, the two congressional officials said.
The U.S. government is examining whether criminal charges can be brought against WikiLeaks founder Julian Assange. Assange is in London fighting extradition to Sweden for questioning in a sexual misconduct investigation. |

5.) Life was not much better for me under the previous confinement assignment of POI watch. Like suicide risk, I was held in solitary confinement. For 23 hours per day, I sat in my cell. The guards checked on me every five minutes by asking me if I was okay. I was required to respond in some affirmative manner. At night, if the guard could not see me clearly, because I had a blanket over my head or i was curled up towards the wall, they would wake me in order to ensure that I was okay. I received each of my meals in my cell. I was not allowed to have a pillow or sheets. I was not allowed to have any personal items in my cell. I was only allowed to have one book or magazine at any given time to read. The book or magazine was taken away from me at the end of the day before I went to sleep. I was prevented from exercising in me [sic] cell daily. The guards would take me to an empty room and allow me to walk. I usually walked in figure eights around the room. When I went to sleep, I was required to strip down to my underwear and surrender my clothing to the guards. my clothing was returned to me the next morning. |

But with respect to the fourth Twitter account, WikiLeaks, no party raised objections as to Twitter's production of records related to it. No person appeared on behalf of Wikileaks in the proceedings before the magistrate judge, who dismissed as moot Twitter's motion for clarification related to production of records from the WikiLeaks account. On its face the Dec. 14 Order seeks information about all those who received the Parties' publications and private messages, mapping their associations and audience. Even after the actual information to be produced under the Order was narrowed by the government pursuant to concerns raised by Twitter (Footnote 4: The government has not conceded that its original Order was improper in any manner. nor has the government agreed never to ask for the full scope or the originally demanded information. As a result, Movant's challenge to the December 14 Order need not be limited to the narrowed demand), it requires Twitter to disclose such information from all of the Parties' twitter-related speech (called 'tweet') for multiple months, i.e. November 15, 2009 to June 1, 2010, regardless o any connection between the postings and WikiLeaks.

Q: Geoff, is it true that prosecutors have not been able to tie Private [Bradley] Manning to Julian Assange and essentially make a link between the two in the case?
MR. MORRELL: Well, what I would say on this is, as much as I'd like to weigh into this, this is, as you know, an ongoing criminal investigation. So it would be inappropriate for me to speak to any -- with any specificity to these issues.
But I would avail myself of this opportunity to admonish or warn you all to be extraordinarily careful about how you report on this story, because one thing I can -- I do feel comfortable in telling you is that this case is being taken extremely seriously by the investigators both here in the Defense Department and, of course, at the Department of Justice. They are hard at work at on building a case here.
So any pronouncements about a connection or lack of connection, those that have been found or are yet to be found, are just premature at this point. So I'd urge everybody to proceed with caution on this, and probably most stories, for that matter.
So I'm not in a position, unfortunately, to tackle that as directly as I'd like to. But that's my admonition to you all, including Mr. [Jim 'Mik'] Miklaszewski in the front row.
Q: Well, why is he being held in solitary confinement?
MR. MORRELL: He's not being held in solitary confinement. That's a misnomer, among many in the reporting of this case. What I -- let me describe how Private First Class Manning is being held. He is not in solitary confinement. He is not in isolation. He is in max -- he is a maximum-custody detainee in a prevention-of-injury status. He is not on suicide watch. He is being held in the same quarter section with other pretrial detainees. He's allowed to watch television. He's allowed to read newspapers. He's allowed one hour per day of exercise.
He is in a cell by himself, but that is like every single other pretrial detainee at the brig. It just so happens that the configuration of the brig is that every individual is confined to his or her own cell. He's being provided well-balanced, nutritious meals three times a day. He receives visitors and mail, and can write letters. He routinely meets with doctors, as well as his attorney. He's allowed to make telephone calls. And he is being treated just like every other detainee in the brig. So assertions by liberal bloggers, or network reporters or others that he is being mistreated, or somehow treated differently than others, in isolation, are just not accurate. And I'm glad you asked the question, so I had the opportunity, hopefully, to clear that matter up once and for all.

Q: Could I just follow up on that? I mean, all of that being said, he still does spend 23 out of every 24 hours in that cell by himself. He's not allowed to exercise in the cell. He's not allowed to arbitrarily just write letters. He has to specifically ask for anything more than, say, one book at a time. Are -- is there any concern that -- because from what we've heard, even the forensic psychologist who spoke with him and examined him recommended that he not be on this protective order. I think that there's a -- there's a question out there as to exactly how the brig commander -- what criteria is being used to keep him under this order for such a long period of time, considering he's still in a pre-trial status.
MR. MORRELL: Just as though he is not being treated any worse than any other detainee, he is not being treated any better than any other detainee. He is not going to receive special privileges, which is essentially what you are asking him to receive. He is being treated exactly like everyone else in the brig is being treated. That's what's appropriate. We treat them all equally. And I don't understand why there would be a need for an exception to those rules to be made for Private Manning -- or anyone else, for that matter.
Q: Well, are there other prisoners who have been under this protective order for the length of time that Private Manning has?
MR. MORRELL: That's probably a question that's best addressed to my colleagues at Quantico, in terms of the population at the brig there, how long some have been there versus others. I don't believe that this is an unusually long period of time. A case is being built to prosecute him on the charges that were -- again, to correct another mis-report yesterday that -- you know, there were cable news reports yesterday that somehow Private Manning was being held without charge -- not just that he was being held in conditions that the media thought were inappropriate, but that he was being held without charge -- and how un-American that is.
As you all know who work in this building, who received the charge sheet back in July, he most certainly has been charged. And he has not only been charged with illegally downloading classified information, but he has been charged with disseminating classified information to people unauthorized to receive it. So those are very serious charges levied against him, related to a very discrete incident involving mostly the downloading of Apache gunship video from Iraq, but also some cables as well were mentioned in the charging sheet back in July. He is, as we mentioned a person of interest in the much larger leak by WikiLeaks of additional classified documents, cables and tactical field reports and so forth. But I think the manner in which he is being held is completely appropriate and completely consistent with how any and all detainees at the brig are treated.
Q: One last question --
MR. MORRELL: Yeah, I'll get -- Mik, I promise you I will give you a chance.

Q: The protective order is not designed to punish him for being charged with those crimes. It's supposed to protect him. I guess we're trying to --
MR. MORRELL: The protective order -- I would -- I would imagine that one -- when one is confined in the brig, it is not just for their protection that we are worried. We are always worried about our protection. He is charged with very serious crimes. That's why you isolate someone behind bars. That's why you confine someone, so that they cannot escape, cannot possibly commit the crimes that they are alleged to have done again.
So it's not -- he is -- I think you have it a little backwards. I think you have it that he is being held for his own protection in the manner which he's being held. That may be, that there -- there are reasons that they think that it is for his own benefit that he be held so. But it can also be that he's being held behind bars because he is a -- deemed a threat, that he has been alleged to have committed a very serious crime that potentially undermines our nation's security, and therefore he needs to be confined during the course of a trial.
But I would just -- what I come back to time and time again, Chris, is the notion that the manner of his confinement is not in the least different from the manner in which anyone else at the brig is being held.
Q: But not everybody's under that protective order.
MR. MORRELL: I'm -- I -- you keep coming back to this protective order. I'm not so sure I know what you're talking about. I described conditions to you, the manner in which he's being held. And my understanding is that is consistent with how every other person in the brig is being held.
Now, the one exception to that could be this suicide-watch issue. He was placed on suicide watch, as I understand it, for two days. So that can be a difference between how others in the brig are being held. But my understanding is that the manner in which he is being held is not punishment for any behavior, but this is the standard protocol for how people at the brig are held, especially people with the gravity of the charges he is facing.

Q: Well, since you mentioned me by name and, through implication, tied me to incorrect reporting, which would be incorrect, I do have a couple of questions.

Mr. PAUL. Mr. Speaker, how did the 20-year war get started? It had been long assumed that the United States Government, shortly before Iraq invaded Kuwait in August of 1990, gave Saddam Hussein a green light to attack. A State Department cable recently published by WikiLeaks confirmed that U.S. Ambassador April Glaspie did indeed have a conversation with Saddam Hussein one week prior to Iraq's August 1, 1990, invasion of Kuwait. Amazingly, the released cable was entitled, 'Saddam's Message of Friendship to President Bush' In it, Ambassador Glaspie affirmed to Saddam that 'the President had instructed her to broaden and deepen our relations with Iraq.' As Saddam Hussein outlined Iraq's ongoing border dispute with Kuwait, Ambassador Glaspie was quite clear that, 'we took no position on these Arab affairs.' There would have been no reason for Saddam Hussein not to take this assurance at face value. The U.S. was quite supportive of his invasion and war of aggression against Iran in the 1980s. With this approval from the U.S. Government, it wasn't surprising that the invasion occurred. The shock and surprise was how quickly the tables were turned and our friend, Saddam Hussein, all of a sudden became Hitler personified.
The document was classified, supposedly to protect national security, yet this information in no way jeopardized our security. Instead, it served to keep the truth from the American people about an event leading up to our initial military involvement in Iraq and the region that continues to today.
The secrecy of the memo was designed to hide the truth from the American people and keep our government from being embarrassed.
This was the initial event that had led to so much death and destruction--not to mention the financial costs--these past 20 years. Our response and persistent militarism toward Iraq was directly related to 9/11, as our presence on the Arabian Peninsula--and in particular Saudi Arabia--was listed by al Qaeda as a major grievance that outraged the radicals who carried out the heinous attacks against New York and Washington on that fateful day.
Today, the conflict has spread through the Middle East and Central Asia with no end in sight.
The reason this information is so important is that if Congress and the American people had known about this green light incident 20 years ago, they would have been a lot more reluctant to give a green light to our government to pursue the current war--a war that is ongoing and expanding to this very day.
The tough question that remains is was this done deliberately to create the justification to redesign the Middle East, as many neo-conservatives desired, and to secure oil supplies for the West; or was it just a diplomatic blunder followed up by many more strategic military blunders? Regardless, we have blundered into a war that no one seems willing to end.
Julian Assange, the publisher of the WikiLeaks memo, is now considered an enemy of the state. Politicians are calling for drastic punishment and even assassination; and, sadly, the majority of the American people seem to support such moves.
But why should we so fear the truth? Why should our government's lies and mistakes be hidden from the American people in the name of patriotism? Once it becomes acceptable to equate truth with treason, we can no longer call ourselves a free society. |

On January 27, 2011, the FBI executed twenty-seven search warrants in twelve states and the District of Columbia as part of the investigation of the DDoS attacks against PayPal. FBI agents today executed more than 40 search warrants throughout the United States as part of an ongoing investigation into recent coordinated cyber attacks against major companies and organizations. Also today, the United Kingdom's Metropolitan Police Service executed additional search warrants and arrested five people for their alleged role in the attacks.
These distributed denial of service attacks (DDoS) are facilitated by software tools designed to damage a computer network's ability to function by flooding it with useless commands and information, thus denying service to legitimate users. A group calling itself 'Anonymous' has claimed responsibility for the attacks, saying they conducted them in protest of the companies' and organizations' actions. The attacks were facilitated by the software tools the group makes available for free download on the Internet. The victims included major U.S. companies across several industries.
The FBI also is reminding the public that facilitating or conducting a DDoS attack is illegal, punishable by up to 10 years in prison, as well as exposing participants to significant civil liability.
The FBI is working closely with its international law enforcement partners and others to mitigate these threats. Authorities in the Netherlands, Germany, and France have also taken their own investigative and enforcement actions. The National Cyber-Forensics and Training Alliance (NCFTA) also is providing assistance. The NCFTA is a public-private partnership that works to identify, mitigate, and neutralize cyber crime. The NCFTA has advised that software from any untrustworthy source represents a potential threat and should be removed. Major Internet security (anti-virus) software providers have instituted updates so they will detect the so-called 'Low Orbit Ion Canon' tools used in these attacks. |
