Richard C. Tallman, chair of the criminal rules advisory committee to the Judicial Conference, responds to US District Judge Emmet Sullivan's April 28, 2009 proposal for expanding the Brady rights of defendants, saying 'We will indeed be considering the proposal; it is on the agenda for our October [2009] meeting in Seattle.' Sullivan's proposal to Federal Rule of Criminal Procedure 16 would require the government to hand over all exculpatory material to the defense. Tallman's letter states Sullivan's proposal is being reviewed at the 'highest levels of the executive branch.' Tallman's letter also notes that the DoJ Criminal Division chief, Lanny Bruer, co-chairs a DOJ internal working group on Brady issues, which is an ex-officio member of Tallman's criminal rules committee, reporting to the Judicial Conference's committee on rules of practice and procedure. Tallman writes to Sullivan that he has 'received assurances that the Department [of Justice] will report back to the committee with its position on the issue by our October meeting.'
